1. Introduction

By accessing and using the services provided by ClariTru ("Business"), you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully. If you do not agree with these terms, you should not use our services.


2. Consent (Opt-In)

By checking the box, you consent to receive messages from ClariTru for the purpose of receiving promotional offers, appointment confirmations, and reminders. You may opt-out of receiving messages at any time by following the unsubscribe instructions or by contacting ClariTru directly.


3. Services Provided

ClariTru offers automation services, including but not limited to patient communication workflows, lead management, appointment scheduling, and marketing services. The Business will provide software, training, and customer support as outlined in the service agreement. Additional services such as marketing or onboarding are available for an additional fee.

4. Payment and Fees
Client agrees to pay all fees associated with services rendered by ClariTru.


All fees are subject to individual quotation and must be approved by the Client in writing or through electronic confirmation prior to the commencement of services.

Full pricing will be provided during your onboarding or consultation and confirmed via invoice. Pricing may vary based on the size of your business or the scope of services provided.

Client agrees to pay all fees as outlined and will be billed accordingly. Payment is due upon receipt of invoice and must be made within 30 days to avoid late fees or service interruption.


All Sales Are Final

All payments made to ClariTru are non-refundable, unless explicitly stated otherwise in a written agreement. By purchasing our services, you acknowledge and agree that all sales are final.


5. User Obligations

As a user, you agree to provide accurate information when requested, and to follow all usage instructions provided by ClariTru. You are responsible for marketing distribution efforts, and ClariTru is not liable for any marketing results.


6. Privacy and Data Protection

Your use of ClariTru’s services is governed by our [Privacy Policy]. By using our services, you agree to the collection and use of your data as described in the Privacy Policy.

ClariTru shall not be held responsible for any indirect, incidental, or consequential damages arising from the use of the services. We make no guarantee of profitability or earnings from the use of our services.

9. Termination

Either party may terminate the agreement with written notice. If you cancel within the first 30 days, you may be eligible for a partial refund, excluding the setup fee.

Refunds:
Except as required by law or stated in a separate agreement, ClariTru does not offer refunds for any service fees paid.

All sales are final.


10. Modifications

ClariTru reserves the right to modify these terms at any time. Changes will be posted on the website, and users will be notified accordingly.


11. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Georgia. Any disputes will be resolved through arbitration in Georgia, as provided by the rules of the American Arbitration Association.


12. Payment Terms

By using the services provided by ClariTru, you agree to pay all applicable fees, including the setup fee, monthly subscription fees, marketing services, and any other charges related to the services offered.


Fees are subject to change. ClariTru reserves the right to modify its fees at any time. You will be notified of any changes in fees via email or other communication methods at least 30 days prior to the new fees taking effect. Continued use of the services after the effective date of the new fees constitutes your acceptance of the changes.


13. Force Majeure

ClariTru shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, technological failures, or governmental actions.

14. Indemnification

You agree to indemnify, defend, and hold harmless ClariTru, its affiliates, officers, agents, and employees from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of our services or your violation of these terms.


15. Miscellaneous

By using ClariTru's services, you agree to comply with all applicable laws and regulations. You are also acknowledging that any content provided to ClariTru remains the intellectual property of its respective owner.

16. Entire Agreement

These Terms of Service constitute the entire agreement between you and ClariTru concerning the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether oral or written.
